Plan a leave

Quick answer: FMLA gives up to 12 workweeks in a 12-month period. On a 40-hour week that is 480 hours; if you have used 104, you have 376 left (9.4 weeks). Under the rolling method each hour comes back 12 months after you used it.

The four 12-month methods

Federal rules (29 CFR 825.200) let an employer measure the 12 months as the calendar year, a fixed leave year such as a fiscal year, 12 months forward from your first FMLA leave, or a rolling 12 months measured back from each day you use leave. With the rolling method, each hour you took comes back 12 months after you took it.

Questions

Is FMLA leave paid?

No. FMLA protects your job and health coverage; pay comes from PTO, state paid leave programs or employer policy.

How are 12 weeks counted if I work part time?

In proportion to your normal workweek. Someone who works 30 hours a week has 12 x 30 = 360 hours of FMLA leave.
